Terms of Service

1. Definitions

“Operator” — Crypterm, the party providing access to the Service.

“Service” — the Crypterm software: the web dashboard and the desktop terminal, together with their updates and accompanying materials.

“User” — an individual who has created an account in the Service.

“Subscription” — the right to use the Service for a paid period.

2. Account

Access to the Service requires an account with a confirmed email address.

The User agrees to provide accurate details and is solely responsible for keeping the password safe and for everything done under the account.

One account is intended for one person. Sharing access with third parties is not allowed.

Any suspected unauthorised access should be reported to support@crypterm.io.

3. Licence

The Operator grants the User a non-exclusive, non-transferable right to use the Service for its intended purpose; subscription features are available during a paid or trial period.

You may not decompile or modify the Service, circumvent technical limits or licensing mechanisms, resell access, or use the Service to build a competing product.

All rights in the Service, its code, design and name belong to the Operator.

4. Subscription, trial and payment

The terminal's basic features are free. A subscription adds the extra features listed in the dashboard. Plans and prices are published in the dashboard and on the website and may change; a change does not affect a period already paid for.

A trial is granted at the Operator's discretion, no more than once per person. The Operator may refuse or end a trial on finding several accounts belonging to one person or any other abuse.

Payment is made in cryptocurrency through a third-party payment provider (NOWPayments). Prices are set in US dollars; the amount due in the chosen cryptocurrency is calculated by the provider when the invoice is created. The Operator does not store payment details and does not control the User's wallets.

Subscriptions do not renew automatically: each period is paid for separately. A payment made before the current period ends extends it from its end date.

A payment counts as made once the full amount has been received and the provider has confirmed it. The subscription starts after that confirmation; confirmation time depends on the blockchain network and is outside the Operator's control.

The User is solely responsible for the correct address, network, currency and amount of a transfer, and bears network, exchange and wallet fees. Funds sent to a wrong address, on a wrong network or in a wrong currency, after the invoice has expired, or short of the full amount may be lost irrecoverably; the Operator is not liable for such losses. An underpayment does not start the subscription; on the User's request the Operator may, but is not obliged to, credit it or return it minus costs.

Changes in the cryptocurrency's exchange rate after payment are no ground for recalculation, top-up or refund.

Access to the digital Service is provided as soon as payment is confirmed, so a paid period is non-refundable, except in the cases set out in section 10 and where a refund is required by mandatory provisions of applicable law.

Where a refund is made, it is paid in cryptocurrency to an address given by the User, at the exchange rate on the refund date and minus network and provider fees, within 30 days of a request to support@crypterm.io. Refunds are not made in any other form.

The Operator may reject a payment, suspend access and ask about the source of funds if fraud, funds of unlawful origin or sanctions evasion are suspected, or at the payment provider's request.

The User is solely responsible for any tax obligations arising from cryptocurrency transactions.

5. Acceptable use

The User agrees not to disrupt the Service: no automated scraping, no load or other attacks, no attempts to access other users' accounts.

The User is responsible for complying with the laws of their own jurisdiction, including rules on crypto exchanges and tax obligations.

The Operator may suspend or terminate access if this section is breached.

6. No investment advice

The Service provides data, signals and analysis tools for information purposes only.

Nothing in the Service constitutes investment, financial, tax or legal advice, an offer, or an inducement to trade.

Trading cryptocurrencies carries a high risk of losing the entire amount invested. All trading decisions are the User's own and are made at the User's risk.

7. Limitation of liability

The Service is provided “as is”. The Operator does not warrant uninterrupted operation, freedom from errors, or the accuracy and timeliness of data received from external sources (exchanges, quote providers).

The Operator is not liable for damages, lost profit or other losses arising from use of, or inability to use, the Service.

The Operator is not responsible for the actions or failures of the payment provider, blockchain networks, exchanges or wallets, including delayed confirmations and funds blocked or lost on their side.

In any event the Operator's liability is limited to the amount actually paid by the User for the subscription over the preceding 12 months.

8. Personal data

The processing of personal data is described in the Privacy Policy, which forms an integral part of these Terms.

9. Changes to these Terms

The Operator may amend these Terms. The current revision is always available on this page and its date is shown at the top.

Users are notified of material changes by email or in the dashboard. Continuing to use the Service after a change takes effect means accepting the new revision.

10. Termination

The User may stop using the Service at any time and request deletion of the account by writing to support@crypterm.io.

The Operator may terminate access if these Terms are breached, having notified the User; where access ends through no fault of the User, the unused part of the paid period is refunded.
